Eligibility: Open only to legal residents of the fifty (50) United States and who are eighteen (18) years of age or older at the time of entry. This Sweepstakes is open only to practicing educators. Employees of Vernier Science Education, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers (collectively the “Employees”), as well as immediate family members and/or those living in the same household of Employees, are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

Agreement to Rules: By participating, the Contestant (“You”) agrees to be fully, unconditionally bound by these Rules, and You represent and warrant that You meet the eligibility requirements. In addition, You agree to accept the decisions of Vernier Science Education as final and binding as it relates to the content of this Campaign.

Campaign Period: The Sweepstakes entry period will begin on August 1, 2024 at 9:00 am Pacific Time (“PT”) and will end on September 15, 2024 at 11:59 pm PT (the “Sweepstakes Period”). All dates are expressed month/day/year.

How to Enter: To enter the Sweepstakes, visit vernier.science/back-to-school online during the Sweepstakes Period. Enter your contact information (name and email) and then complete one or more of the entry tasks listed on the Vernier Sweepstakes page during the Sweepstakes Period. Participants who complete the contact form and complete at least one task are considered “Entrants.” Completion of each task entitles an Entrant to a separate entry. There are nine tasks in this Sweepstakes. Some tasks are worth multiple entries, such as sharing a photo with a Vernier product on social media (5 entries) and sharing the sweepstakes with a friend (2 entries). All other tasks are worth one entry. Odds of winning are dependent upon the total number of entries.

By submitting an entry to the Sweepstakes or using Facebook, YouTube, Instagram or X, YOU AGREE TO ABIDE BY THE TERMS OF SERVICE OF THAT SOCIAL MEDIA PLATFORM. 

Entrants may only win one (1) prize per household. Any sort of automated entry (e.g., entry via the use of a bot) is strictly prohibited, and any Entrant suspected or found to be submitting automated entries of any kind will be disqualified. Entrants must be unique individuals to be considered valid; individuals who create multiple entrant profiles with different contact information will be disqualified. 

Message and data rates may apply to the use of a mobile phone/device to participate in the Sweepstakes. You are strongly advised to check your mobile phone/device carrier’s rate plan before attempting to participate in the Sweepstakes via use of an app. Wireless internet service may not be available in all areas. 

Vernier hereby grants to each Entrant a limited, non-transferable, non-exclusive, non-sublicensable, revocable right to use its trademarks solely for purposes of and limited to including them in the photos submitted in this Sweepstakes. Such right and license will automatically expire without further act of any party at the expiration of the Sweepstakes Period, unless specifically extended on an individual basis by Vernier in writing at their sole discretion. Any other uses of the Vernier trademarks will be a violation of intellectual property rights.

Winner Selection and Notification:

The Sweepstakes will run for 46 days. One grand prize winner and five first prize winners will be randomly selected from a pool of valid entries on September 16, 2024. Winners will be notified at the email provided by the Entrant. Vernier will make two attempts to contact the winners. If a winner does not respond within 48 hours, the winner will be redrawn. 

Winners will be required to provide a full mailing address and phone number to receive the prize. Noncompliance, failure to return any documents within the time specified, failure to respond to notification attempts, or returns of any prize/prize notification as undeliverable will result in disqualification and an alternate winner will be selected using the criteria specified herein. All decisions of Vernier relating to the Sweepstakes are final.

No cash or other prize substitution shall be permitted, except at Vernier Science Education’s discretion. The prize is nontransferable. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by Winner is permitted. Acceptance of prize constitutes permission for Vernier Science Education to use Winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

ANY VIOLATION OF THESE OFFICIAL RULES BY WINNER (AT VERNIER SCIENCE EDUCATION’S SOLE DISCRETION) WILL RESULT IN WINNER’S DISQUALIFICATION AS WINNER OF THE CAMPAIGN, AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

Rights Granted by You: By entering this contest, You understand and agree that Vernier Science Education; anyone acting on behalf of Vernier Science Education; and Vernier Science Education’s licensees, successors, and assigns shall have the right, where permitted by law, to print your first name, last initial, and state on the Vernier webpage and its social media platforms without any further compensation, notice, review, or consent. 

Identity of Entrant:  In the event of a dispute about the identity of an entrant, entries will be declared/made by the Authorized Account Holder of the email address entered on the Entrant’s entry, and if a prize is won, it will be awarded to the email account owner.  “Authorized Account Holder” is defined as the natural person who is assigned to an email address by an Internet Access Provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses.

Terms & Conditions: Vernier Science Education reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Campaign should virus, bug, non authorized human intervention, fraud, or other cause beyond Vernier Science Education control corrupt or affect the administration, security, fairness, or proper conduct of the Campaign.

Limitation of Liability: By entering, You agree to release and hold harmless Vernier Science Education and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligence or not, from: (i) such entrant’s participation in the Campaign and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; (v) electronic or human error in the administration of the Promotion or the processing of entries.

Disputes: THIS CAMPAIGN IS GOVERNED BY THE LAWS OF THE UNITED STATES AND OREGON, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Campaign, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in OR having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this Campaign). Participant further waives all rights to have damages multiplied or increased.

Privacy Policy: Information submitted with an entry is subject to the Privacy Policy stated on the Vernier Science Education website.
